Hosting & Domain Agreement

PLEASE READ THIS HOSTING & DOMAIN AGREEMENT CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR HOSTING, SERVICES & DOMAIN RIGHTS AND REMEDIES.

The English version of this Hosting Agreement is the only official version. Translated versions are for convenience only and are not legally binding. In case of any conflicts, the English version prevails.

1. Terms For Domain Registration

i. Domain Registry

OneNet Servers UK domain services/products are subject to NAMESILO and Hexonet, our domain registrars. We are an ICANN-accredited registrar, and we work in compliance with the agreements that OneNet Servers UK has with these registrars. By using our domain services, you (“you” or “your”) agree to the terms and conditions set forth by:

(i) ICANN, and/or
(ii) the applicable registry for the TLD or country code top-level domain (“ccTLD”).

You agree that OneNet Servers UK does not lend you access to its registrar connections or registry access, and you will not attempt to gain access to these systems. You agree to provide complete, accurate, and current data for each registrant to be added to a registry under the Registry Operator’s requirements.

ii. Domain Registration

When registering a domain, you agree to:

(a) The data you provide for domain registration is complete and correct, including but not limited to your name, email, telephone number, residential/corporate address, and valid email address.
(b) You are eligible under the registry’s policies for the applicable TLD for the duration of the domain name registration.
(c) You have not had a rejected application for the domain with another registrar using the same data and eligibility criteria.
(d) Successful registration does not prevent you from being challenged by others claiming a right to the domain name.
(e) The registry or registrar can cancel the registration if the data provided is found to be untrue, incomplete, or misleading.
(f) You agree to adhere to all requirements and provide all necessary documentation. Failure to do so may result in the deactivation or cancellation of the domain name without liability to OneNet Servers UK.

iii. Payments

You agree to pay all fees associated with domain registration at the time of order. We reserve the right to change our pricing, with such changes communicated via email and becoming effective immediately. Domains will not be activated until payment is confirmed.

iv. Domain Renewal

All renewals are subject to this Agreement, as amended. Domain renewals are non-refundable. If we cannot take payment from the payment method you have on file and you fail to respond to our renewal notices, your domain will expire. It is your responsibility to keep payment information current.

v. Restricted and Premium Domains

Certain domain names may be restricted or classified as premium by the registry. We reserve the right to reject applications for such domains.

vi. Domain Dispute Resolution

You agree to abide by ICANN’s UDRP for all domains subject to the UDRP and the Nominet Dispute Resolution Service (DRS) for UK .uk domains.

2. Web Hosting Services

i. Data Provision

You agree to provide accurate and current contact details and update them within seven (7) days of any change.

ii. Hosting Migration

During migration to our servers, we do not guarantee that all files, emails, and applications will be transferred. You are responsible for ensuring that all necessary data is backed up before migration.

iii. Termination of Service

Upon termination, you must discontinue the use of our hosting services and remove all content from our servers. We will not transfer or FTP your content to another provider. Failure to remove content may result in deletion without recovery.

iv. Suspension, Cancellation, and Deletion

We may suspend or terminate your services for reasons including non-payment, violation of this Agreement, or activities harmful to our network. Upon termination, your content may be deleted.

v. Indemnity

You agree to indemnify, defend, and hold harmless OneNet Servers UK, its officers, employees, and agents from any claims, damages, or liabilities arising from your use of our services.

vi. Resource Usage

You agree to use our hosting resources responsibly and not exceed allocated CPU, bandwidth, or disk usage limits. We reserve the right to suspend or terminate accounts that violate these terms.

vii. Bandwidth Usage

Exceeding your allocated bandwidth may result in the suspension of your account. Upgrades are available for additional bandwidth needs.

3. Service Level Agreement (SLA)

We strive to provide reliable services. Our SLA includes:

  • Uptime Guarantee: We aim for 99.9% uptime, excluding scheduled maintenance.

  • Support Response Time: We commit to respond to support inquiries within [X] hours.

  • Compensation: Service credits may be issued if we fail to meet SLA targets, as detailed in our SLA document.

4. Data Backup and Retention

We perform weekly backups for all Web Hosting, Reseller Hosting, and WordPress Cloud Hosting accounts, including emails. These backups are retained for up to three (3) months, even after service termination. For VPS, Dedicated, and Bare Metal Servers, we do not provide backups. It is your responsibility to implement your backup systems for these services.

5. Force Majeure

OneNet Servers UK will not be liable for failures to perform due to events beyond our control, including natural disasters, acts of government, or network failures.

6. Spamming and Phishing

OneNet Servers UK has a zero-tolerance policy towards spamming and phishing activities. Violations may result in immediate suspension or termination of services.

7. Compliance with the Law

You agree to use OneNet Servers UK services in compliance with all applicable laws in the UK. Accounts will be suspended or cancelled if found to violate legal standards.

8. Limitation of Liability

8.1 Limitation of Liability
Our total liability to you under this Agreement for any claims, whether in contract, tort (including negligence), or otherwise, shall be limited to the total amount you have paid to OneNet Servers UK for the affected service(s) in the 12 months preceding the claim.

8.2 Exclusions of Liability
In no event shall OneNet Servers UK be liable for any:

  • Indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, goodwill, business opportunity, or data, whether or not such damages were foreseeable, arising from or in connection with the use or inability to use our services.

  • Loss of or damage to data, including but not limited to data stored on servers, backups, or the failure to perform regular backups. While we perform regular backups for certain services, you are responsible for maintaining your own backups for other services.

  • Downtime or interruption of services, whether caused by scheduled maintenance, third-party failures, or events beyond our control (e.g., force majeure events such as natural disasters, acts of war, government actions, or other uncontrollable factors).

  • Loss of business, interruption, or delay caused by factors outside of our control, including issues with the internet, other service providers, or force majeure events.

8.3 No Liability for Third-Party Services
We are not liable for any third-party products, services, or content that we may integrate with or use in connection with our services, including but not limited to payment processors (such as PayPal, Stripe, etc.), software, plugins, or external hosting services. Your use of such third-party services is at your own risk, and their liability will be governed by their respective terms and conditions.

8.4 Acknowledgment of Risk
By using our services, you acknowledge that there are inherent risks, including but not limited to the risks of hacking, unauthorized access, service downtime, data loss, and damage to devices or data. We do our best to minimize these risks through security measures, but we cannot guarantee complete security or uptime.

8.5 No Guarantee of Service Continuity
We do not guarantee that our services will always be available or uninterrupted. While we aim to provide high availability and excellent service, we cannot be held responsible for delays, interruptions, or failures caused by events outside of our control, including but not limited to failures of internet infrastructure, hardware, and software issues, or other technical problem

9. Governing Law

This Agreement is governed by the laws of the United Kingdom. Any disputes will be resolved in the courts of the United Kingdom.
